Contract and Terms of Agreement

ART INSTRUCTION REGISTRATION, APPLICATION, AND CONTRACT FORM TERMS OF AGREEEMENT 2010 for VIRGINIA K. FREYERMUTH, Inc. (VKF, Inc.):

This is an application for acceptance; if it is approved and the student enrolled, it becomes your registration form and our contract for all purposes. If this application is not approved, your payments will be refunded promptly. Sessions fill up quickly due to small class sizes, so register early! Enrollment is limited. Applications are on a first-come, first-served basis. Registration is complete only when the application is accepted, and full payment is received and confirmed. If a session is filled at the time you submit your registration request, you will be placed on a wait list and your full tuition fee will be returned. Refunds will be granted up to seven days before a session begins; however, a nonrefundable registration fee of $15 is included in the tuition except in the event the session is full or cancelled for any reason by VKF, Inc. A student who withdraws during the week before a session will be granted a refund less the $15 registration fee only if that space can be filled from the wait list. No refunds will be given once a session begins. A $25 fee will be charged for receipt of a check with insufficient funds. There are no refunds or make-up classes for student absences. All written and visual materials produced by VKF, Inc. are copyrighted, all rights reserved, and remain the intellectual property of the corporation.

Supplies and Materials: Selected supplies are included in on-location Adult and High School Workshops. We promote the safe use of materials and can furnish accepted students with guidelines of acceptable art supplies for use in the studio. Student use of toxic solvents and toxic adhesives is not allowed in on-site classes.

Cancellations: While every effort is made to adhere to the published schedule of a session, VKF, Inc. reserves the right to cancel classes and change times. Students will be called if there is a change or cancellation. A make-up class will be offered in the event of such cancellation; we regret that no refunds are available.

Gift Certificates: Gift certificates may be applied to VKF, Inc. goods or services. Gift certificates are a final sale and cannot be refunded or replaced.

Please Note: VKF, Inc. reserves the right to remove any disruptive student from a class and tuition paid will not be refunded. In the case of a minor, the parent or guardian will immediately be notified.

Liabilities: The Student and also Parent/Legal Guardian of a Minor hereby waives any and all liability of VKF, Inc. for any bodily injury or loss, material or otherwise, incurred while following the instructor’s directions. Each Student and Parent/Legal Guardian of a Minor assumes all the risks of personal damage inherent in the use of art materials and in the practice of artistic and written work. Any disputes between VKF, Inc. and any signatory to this form will be submitted to arbitration in MA. When approved by VKF, Inc., this is a Massachusetts contract. All proceedings and suits in any way concerning this contract will be brought only in Plymouth County, MA, and all parties agree to submit to the jurisdiction of the courts sitting in that state and county and agree not to plead hardship or inconvenient forum. We are not responsible for any property left on the premises. Students take courses at their own risk. VKF, Inc. is not responsible for any emotional, mental or intellectual damages. This instruction is not intended to be Art Therapy. VKF, Inc. makes no guarantees that instruction will result in specific gain.
